Sricctv User Agreement

Shenzhen Sricctv Technology Co., Ltd (hereinafter referred to as "Sricctv") hereby reminds you to read carefully and fully understand this "Sricctv User Agreement" (hereinafter referred to as "Agreement"). Minors should read it together with their legal guardian. Unless you have read and accepted all the terms of this agreement, you have no right to register or use the Sricctv software (hereinafter referred to as "the software") or its services. If you enter the registration process and tick "I agree to the Sricctv User Agreement", you will be deemed to have accepted this agreement and agreed to be bound by its terms.

This Agreement is an agreement between you and Sricctv regarding your download, installation, and use of Srihome, Sricam, or ifhome software (collectively, the "Sricctv software") and related services. The term "user" in this agreement refers to an individual who registers, logs in, and uses this service (hereinafter referred to as "you"). The content of this agreement also includes the relevant agreements, business rules, policies, and notices regarding the use of this software that Sricctv has released and may continue to release in the future. Once officially released, the foregoing content is an integral part of this agreement and has the same legal effect.

Sricctv reserves the right to modify the terms of this agreement when necessary. You may log in to the Sricctv website or download the latest version of the Sricctv software to view the revised agreement. After the terms are changed, if you continue to use the Sricctv service, you are deemed to have accepted the revised agreement. If you do not accept the revised agreement, you should stop using the Sricctv service.

Article 1 Software Functions

1.1 This software provides support for all products and equipment offered by the Sricctv platform, aims to ensure the normal use of the equipment, and introduces new functions according to user needs. It provides a convenient entry point for wireless network access on mobile devices. This software offers real-time viewing, two-way voice dialogue, alarm notification, cloud services (an optional value-added service — before using it, please carefully read the specific terms or usage rules of that individual service), camera sharing, and other functions.

Article 2 User Registration

2.1 Account

If you want to use this software, you need to register a Sricctv account and provide relevant personal information on the registration page. After successful registration, you can log in and use the service.

You must promise and guarantee:

• 2.1.1 All registration information you submit is true and accurate.
• 2.1.2 Your behavior of using the smart camera of the Sricctv solution is legal.
• 2.1.3 You may terminate the use of your account at any time according to the Sricctv account instructions. The software will retain or terminate your account in accordance with Article 6 of this agreement. You must keep your login information confidential, prevent it from being obtained or used by others, and be responsible for all actions performed under your account on this website. You must notify us as soon as possible of any unauthorized use or suspected unauthorized use that may violate the law. We will not bear any legal responsibility for losses caused by your failure to comply with the above requirements.

2.2 Third-party login

If you use a third-party account to authorize login to the Sricctv software, you are deemed to accept this agreement and agree that Sricctv may retrieve your information from the third party (limited to the information necessary for your use of the Sricctv software).

2.3 Account security

You are responsible for properly safeguarding your account information and password security, and you are legally liable for activity performed under your account and password. You agree not to disclose account and password information to others under any circumstances. Sricctv does not assume any responsibility if your account and password are illegally used by others due to your own reasons. Such reasons include but are not limited to: arbitrarily disclosing your account number, password, and other registration information to a third party; sharing the same account number among multiple people; installing illegal or unknown programs.

2.4 Password recovery

If you lose or forget your registered password, you may apply to retrieve it through the email account registered with your username. Sricctv's password recovery mechanism cannot verify whether the user of the mailbox is the actual account owner. Sricctv does not assume any responsibility for losses caused by impersonation when retrieving the account and password. You acknowledge that the responsibility for safeguarding your password lies with you. Sricctv does not guarantee that you will successfully recover your password through the registered username or email account.

Article 3 User-Terminal Protocol

3.1 License

According to the provisions of this agreement, the software grants you the following non-transferable, non-exclusive licenses:

• 3.1.1 The right to use the software.
• 3.1.2 The right to download, install, and use the software for all of your network communications.

3.2 Restrictive clauses

The authorization granted to you under this agreement is subject to the following restrictions:

• 3.2.1 You must not sub-license, distribute, or otherwise commercially exploit this software in any form.
• 3.2.2 Unless otherwise expressly permitted by law, you may not modify, translate, adapt, merge, exploit, disassemble, transform, or reverse-compile any part of the software or derivative products.
• 3.2.3 You must not use this software to create identical or competing services.
• 3.2.4 Except for the express authorization in Article 3.1, this software does not explicitly or implicitly authorize any other use or exploitation.

3.3 Ownership of rights

• 3.3.1 Sricctv permits you to use and download this software.
• 3.3.2 Sricctv (and its licensors) own all related intellectual property rights and other rights and interests in the software.

3.4 Expenses

You must bear the cost of obtaining this software, as well as personal internet access or communication fees, information fees, and other related fees charged by third parties (including but not limited to telecommunications or mobile communication providers). If value-added telecommunications services are involved, we recommend you confirm related fees with the value-added service provider.

3.5 Updates

You agree that any updated version, future version, update, or other change to this software is bound by this agreement.

Article 4 User Content

4.1 User content

• 4.1.1 "User content" refers to all content (for example: pictures, video images, audio, text, data, or any other content) generated when the user publishes content or otherwise uses the software.
• 4.1.2 You are solely responsible for your user content, and you bear the risk that you or any third party may be identified as a result of the disclosure of your user content.
• 4.1.3 You agree that your user content is subject to the restrictions in Article 5.

4.2 Feedback

• 4.2.1 Your suggestions (or "feedback") to Sricctv constitute your promise and guarantee that you have the right to grant Sricctv an irrevocable, non-exclusive, royalty-free (or otherwise pre-paid) global authorization to use such feedback and related information in any reasonable way. At the same time, you promise and guarantee that the above feedback does not infringe the intellectual property rights or any other rights of others, and that such feedback information is non-confidential and non-proprietary.
• 4.2.2 You agree not to provide Sricctv with any information that you consider, or that is subject to, confidentiality obligations or proprietary information.

Article 5 Restrictions on Rights

5.1 Prohibited content

You agree that in the process of using this software and its related services, you will bear all legal responsibilities arising from the risks caused by the following actions:

• 5.1.1 Undermining the basic principles established by the constitution.
• 5.1.2 Endangering national security or leaking state secrets.
• 5.1.3 Violating public order or good customs.
• 5.1.4 Spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crime.
• 5.1.5 Insulting or slandering others, or infringing on the lawful rights and interests of others.
• 5.1.6 Other content prohibited by laws and administrative regulations.

5.2 Prohibited behavior

You agree not to engage in the following behaviors in this software:

• 5.2.1 Publishing or sharing computer viruses, worms, malicious code, or software that deliberately destroys or alters computer systems or data.
• 5.2.2 Collecting other users' information or data, such as email addresses, without authorization.
• 5.2.3 Maliciously using the software in an automated way that places an excessive burden on the server or otherwise interferes with or damages the website server and network connection.
• 5.2.4 Attempting to access server data or communication data of this software without authorization.
• 5.2.5 Interfering with or disrupting the use of this software by other users.

Article 6 Modification and Termination

6.1 Modification

• 6.1.1 This agreement may be changed at any time. If there are substantial changes, we will notify you through announcements or messages within the software. If you continue to use the software after the change, you are deemed to agree to be bound by the revised terms.
• 6.1.2 Sricctv reserves the right to modify, suspend, or close any service of this software at any time without prior notice.
• 6.1.3 You agree that Sricctv shall not be liable to you or any third party for modifying, suspending, or closing any service of this software.

6.2 Termination

• 6.2.1 This agreement is effective from the date you accept it and remains effective during your use of the software until terminated in accordance with this agreement.
• 6.2.2 Notwithstanding the above provisions, if you use the software earlier than the time you accept this agreement, you hereby acknowledge and agree that this agreement takes effect when you first use the software, unless terminated earlier in accordance with this agreement.
• 6.2.3 We may (1) reserve your right to use the software or your account on this website in accordance with the provisions of the law; or (2) terminate this agreement at any time for any reason, including a good-faith belief that you have violated our acceptable use policy or other provisions of this agreement, with or without notice.
• 6.2.4 Without being limited by the preceding paragraph, if the user infringes a third party's intellectual property rights and Sricctv receives notice from the intellectual property owner or its agent, Sricctv reserves the right to terminate this agreement.
• 6.2.5 Once this agreement is terminated, your right to use the software ends. You should be aware that termination of your software service means that your user content will be deleted from our database. Sricctv will not be liable to you for terminating this agreement, including terminating your user account and deleting your user content.

Article 7 Third Party

7.1 Third-party platforms

You acknowledge and agree that some of our services rely on third-party technical support, for example, Apple iOS and Google Android systems. You understand that this agreement is signed between you and Sricctv, not between you and the aforementioned third party. You agree to abide by Sricctv's conditions for your use of the software's services.

7.2 Third-party information and services

• 7.2.1 This software contains information and services from third parties. Sricctv does not control and is not responsible for third-party information and services, nor does it have an obligation to inspect or monitor its content.
• 7.2.2 Sricctv provides such information and services only for your convenience or to meet the needs of third parties.
• 7.2.3 You bear legal responsibility for any risks arising from your use of third-party information and services.
• 7.2.4 When you visit or browse third-party information and use third-party services, the third party's terms and policies apply.

7.3 Other users

• 7.3.1 This software contains user content provided by other users. This software does not control and assumes no legal responsibility for such user content. Sricctv has no obligation to inspect, monitor, review, approve, promise, or guarantee user content. You bear legal responsibility for the risks arising from the use of user content and interaction with other users.
• 7.3.2 Your interaction with other users is solely between you and those users; Sricctv does not assume any legal responsibility for such interactions. You understand and agree that Sricctv shall not be liable for the results of such interactions.

Article 8 Compensation

• 8.1 You agree to use the software in a way that does not infringe Sricctv's rights, and to indemnify Sricctv from any third-party complaints, lawsuits, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising from or related to the following actions:
  • 8.1.1 Your use of this software.
  • 8.1.2 Your user content.
  • 8.1.3 Your violation of this agreement.
• 8.2 Sricctv reserves the right to defend itself and to seek compensation.
• 8.3 You agree that, without Sricctv's written consent, you may not unilaterally settle any lawsuit between you and Sricctv against a third party.
• 8.4 Sricctv will make reasonable efforts to notify you of such litigation, litigation actions, or progress.
• 8.5 Under no circumstances will this software be liable to you or any third party for any indirect, consequential, punitive, incidental, special, or punitive damages arising from this agreement. You personally bear the risk of damage to your computer system or mobile communication device database caused by accessing and using this software.

Article 9 Disclaimer

Sricctv and the software do not assume any legal responsibility in the following situations:

• 9.1.1 Providing your personal information in accordance with legal requirements or the requirements of relevant government departments.
• 9.1.2 Any leakage of personal information caused by your improper use.
• 9.1.3 Any service interruption or obstruction caused by hacker attacks, computer virus intrusion, illegal-content filtering, harassment-information shielding, government regulation, or any other network, technology, communication line, or information-security management measures that cannot meet user requirements.
• 9.1.4 Losses caused to the user by force majeure such as third-party (e.g., operator) communication line failures, technical issues, network or computer failures, or system instability.
• 9.1.5 Risks arising from the use of this software that may come from anonymous or pseudonymous information containing threats, defamatory, offensive, or illegal content from others.
• 9.1.6 Sricctv hereby declares that it does not guarantee — expressly, implicitly, or in any form — the timeliness, safety, or accuracy of the software and its partner companies' services.

Article 10 Privacy Policy

The Privacy Policy is part of this agreement, and protecting user privacy is a fundamental policy of Sricctv. Sricctv will collect, store, use, disclose, and protect your personal information in accordance with the privacy policy published in this software. Please read the privacy policy in its entirety to better protect your personal information.

Article 11 Notice

• 11.1 You must provide a valid email account that you currently use in your Sricctv software account. The software is not responsible for the risk that the email account you provided cannot be used or that we cannot deliver a notice to you for any reason.
• 11.2 Announcements issued in this software and emails containing such notices sent to you constitute timely and effective notices to you.

Article 12 Applicable Law

• 12.1 This agreement is governed by the laws of the People's Republic of China.
• 12.2 If a dispute arises between the parties, it should be resolved through friendly negotiation. If negotiation fails, you and Sricctv agree to submit the dispute to the people's court with jurisdiction at the place where this agreement is signed.

Article 13 Independence

If any provision of this agreement is unenforceable for any reason, the other provisions of this agreement continue to apply, and the unenforceable provision will be modified so that it can be applied in accordance with the law.

Article 14 Completeness

• 14.1 This agreement (including the privacy policy) is the final, complete, and exclusive agreement between you and the software regarding matters related to the software, and supersedes and consolidates the parties' prior end-user licenses or authorizations (including terms of service and privacy policy) discussions and agreements regarding such matters.
• 14.2 The titles of each clause are for ease of reading only and do not carry any legal or contractual obligations.
• 14.3 Unless Sricctv agrees in writing, you may not assign the rights and obligations stipulated in this agreement. Any attempt to assign in violation of the above is invalid.
• 14.4 The copyright of this Agreement belongs to Sricctv. If you have any questions about this Agreement, please contact Sricctv's customer service department.
